Select work realms are widely known to be comparatively dangerous, with serious accidents and fatal injuries to workers occurring at singularly high rates.

The construction industry is certainly a case in point, with stories — many of them decidedly tragic — seemingly arising almost every day to underscore the pronounced perils for employees who labor on roadway improvements, in commercial and residential building projects and on other matters in Colorado and across the country.

A tragic construction-related outcome that occurred last month in north central Colorado emphasizes that point. Although a number of material details regarding the matter are still being investigated to determine the root cause of a fatality, the bottom line is that something wrong happened, with a road worker losing his life as the result.

That employee was working with other construction workers on a road-resurfacing project on Colorado Highway 9 when he was struck and fatally injured by a backward-moving piece of paving machinery called a rotomiller.

Federal investigators from the Denver office of the Occupational Safety and Health Administration are investigating the fatality. As noted above, the probe is ongoing.

Negligence of some sort and/or a product defect would certainly appear to have played a central role in the tragedy, with one regulatory official involved in the investigation stating that a contributing factor in the accident may have been a blind spot on the rotomiller.

Wrongful death in any context is obviously a devastating occurrence and an outcome that is rendered singularly catastrophic because, in the absence of negligence, a tragic result would likely not have occurred.

Nothing, of course, can compensate for the loss of a loved one. In the aftermath of a loss, though, many families feel empowered through their ability to pursue a legal remedy that acknowledges third-party culpability, provides compensation that can help with future needs, and can additionally serve to deter similarly negligent conduct by other parties going forward.
